Cross-border Mediation success: Macao Mediator featured in top 10 exemplary cases of 2022

The Guangzhou Intellectual Property Court has recently published its top 10 exemplary cases of 2022, of which one of the selected cases was mediated by Ms Amy Wong, CEO of Macao Victory International. This case serves as a testament to the power of collaborative mediation in resolving cross-border intellectual property disputes.

In today's global business landscape, cross-border intellectual property disputes have become increasingly prevalent, and resolving them can be a complex and costly process. However, this recent case, involving a German company and three Chinese companies demonstrates that a collaborative approach to mediation can lead to a mutually acceptable resolution.

The Guangzhou Intellectual Property Court assigned two mediation experts from Hong Kong and Macao to the case. These experts utilized their skills and knowledge to bridge the legal and cultural differences between the parties and identify their salient needs.

The mediation expert from Hong Kong used legal precedent as independent evaluation opinions to help both parties overcome their differences and find a mutually agreeable solution. Ms Amy Wong of Macao Victory International, focused on fact-finding and objective analysis, providing an assessment of the case while recommending a minimum settlement amount based on previous similar cases.

Through the collaborative efforts of the mediation experts, the parties were able to reach a settlement of RMB 24,000 (approximately USD 3,720) for both cases, avoiding costly and time-consuming litigation.

This successful case demonstrates the importance of collaborative and cross-disciplinary approaches in resolving complex intellectual property disputes. The mediation experts utilized both evaluative and facilitative mediation techniques, bridging the gap between different legal systems and cultural backgrounds to reach a mutually acceptable resolution.
